Probation reinstated after man tests positive for meth

Probation was reinstated Monday for a 40-year-old Bodie Flats man with a long criminal history after he admitted using methamphetamine.

District Judge Michael Gibbons ordered John Christy to serve an additional 90 days in Douglas County Jail as part of his probation. He was sentenced in February to three years in Nevada State Prison, suspended, and placed on five years' probation for possession of a stolen motor vehicle.

Christy was arrested on the probation violation less than three weeks after he completed a 30-day sentence.

He admitted using methamphetamine at a birthday party March 9.

"I understand how this looks," Christy said. "This is the last place I want to be. I am so sorry."

Prior to his arrest, Christy claimed to have been clean for more than two years.

"I have changed, but it (the methamphetamine) was put in my face and I had no control at all. My preparation went out the window. No one is more disappointed in me than myself," he said.

Prosecutor Laurie Trotter asked that Christy be sent to prison.

"He's not a candidate for probation. He will continue to use and continue to commit crimes," Trotter said.

Gibbons said he had misgivings about reinstating Christy's probation.

"You haven't earned another chance," he said.

He recommended Christy apply for in-patient treatment while he's in custody which would count against his sentence.

If Christy doesn't go to treatment, he must serve the full 90 days with 18 days credit for time served.

"I hope I don't have to see you under these circumstances again," Gibbons said.
