Plea change in battery, robbery of teenagers

A 22-year-old Gardnerville man faces up to five years in prison and a $10,000 fine at his sentencing July 14 in the robbery and battery of two teenagers.

Miguel Rubio pleaded guilty June 2 to battery causing substantial bodily harm in connection with the March 13 incident. He admitted throwing a beer can that struck the head of the victim and struck him with his fists.

"I was with Andrew Tagay," Rubio said. "I threw a beer can and struck him (the victim) with his fists."

Prosecutor Laurie Trotter said the victim had "a big goose egg" on his head and suffered recurring pain.

She said she was concerned that Rubio not contact the victims.

"I want to make sure they are protected," she said.

Conditions of Rubio's release include no contact with the victims, no gang affiliation, weapons, drugs or alcohol.

Rubio is wearing an ankle monitor that tracks his movements,

Rubio originally pleaded not guilty and was set for trial July 13.

He and Tagay were accused of "jumping" the two teenagers who were on their way home after returning DVDs to a Gardnerville grocery store.

According to reports, deputies were called to a residence near Scolari's at 10 p.m. March 13 after the victims said two men jumped them on their way home, demanded money and threw beer cans at them.

The victims said the defendants shouted "Tokers" at them as they ran away.

One of the teenagers was hit in the back of the head with a full beer can that exploded on impact. The other teen had a cut over his left eye.
