Man set to be sentenced in domestic battery

Sentencing is set Jan. 30 for a Gardnerville man who pleaded guilty to battery that constitutes domestic violence.

Frank Duarte, 31, who has 22 prior criminal contacts in Douglas County, admitted striking the victim in the mouth on Christmas Day.

East Fork Justice Jim EnEarl agreed to release Duarte pending sentencing, but warned him he cannot consume drugs or alcohol or have contact with the victim.

EnEarl said he was inclined to impose a more stringent sentence than the recommended two days in Douglas County Jail.

"Over the course of a number of years, I've put you in jail for 18 months to 24 months total," EnEarl said. "I don't appreciate your lifestyle. I think you do incredibly stupid things when you're drunk and you keep on drinking. I will say this, you've always owned up."

Duarte agreed to return for sentencing and said he didn't want to lose his new job at Fantasy Girls in Reno which he described as "kind of a sleaze joint."
