Burglar back in custody for drinking

A Carson Valley man who served one year in Douglas County Jail for a string of burglaries was back in custody Monday for minor consuming.

East Fork Justice Jim EnEarl sentenced Matthew Golden, 20, to 60 days in Douglas County Jail for the most recent offense to be served consecutively to any suspended sentence he may receive in district court.

Golden was arrested early Monday when deputies responded to his Langley Drive apartment for a noise complaint.

Golden said he was returning from 7-Eleven when deputies found him with alcohol.

He was released from Douglas County Jail on July 11 after serving a year for burglaries in Carson Valley he committed with his wife, Amanda Golden.

They admitted burglarizing Norwest Martial Arts several times and Pizza Factory.

In a plea agreement with the district attorney's office the Goldens received suspended prison sentences and were ordered to complete the jail terms. They were placed on five years probation.

Matthew Golden is also being held without bail on a probation violation.

"This may well violate your probation next door (in district court)," EnEarl said. "You're going to go to prison because of a beer?"

Golden who was an Army military policeman at the time of his burglary arrest a year ago, told EnEarl he was still "working with the Army to see if they'll discharge me."

Golden refused an attorney Monday and entered a guilty plea to minor consuming.

Prosecutor Laurie Trotter asked EnEarl for a six-month sentence.

"Given the fact that he had all that (probation) hanging over his head, I am asking for six months in jail for this offense. He did not serve any additional time for the second case," she said.

In handing down the 60-day sentence, EnEarl warned Golden not to come back.

"The state asked for six months, that's a pretty legitimate request," he said. "If you come back here again, I won't handle it in this fashion."

By earning good time credits and with credit for time served prior to her sentencing, Amanda Golden was released from jail on May 27.

Gibbons warned Matthew Golden when he was sentenced in December he wouldn't hesitate sending him to prison if he violated probation. He faces up to five years.
