Probation in trafficking case

A 19-year-old Indian Hills man was sentenced to five years probation Tuesday after successfully completing the Department of Corrections regimental discipline program.

"We all care a great deal about you," District Judge Dave Gamble told Casey Smith.

Smith pleaded guilty to trafficking in a controlled substance stemming from a Feb. 28, 2007, drug sale to an undercover officer.

Lawyer Tod Young recommended his client be placed in the Western Regional Drug Court because he said Smith needs more supervision, referring to his juvenile record.

"He does really, really well when he's really, really watched," Young said. "If we just say, 'OK, you're on probation, go be good,' it's probably not enough."

Gamble sentenced Smith to six years in Nevada State Prison, suspended, and placed him on probation. He is subject to random search and seizure for alcohol, controlled substances, contraband and any indicators of drug sales or trafficking.

He was ordered to perform 40 hours of community service and may have no contact with his codefendants.

Gamble gave him credit for 315 days time served.

n Probation was revoked Tuesday for a 23-year-old Dresslerville man who was picked up for drinking alcohol one day after sentencing by District Judge Dave Gamble.

"After all that, the next day you were drunk?" Gamble asked Thomas Montgomery.

He imposed a one-year sentence in Douglas County Jail and gave Montgomery credit for 98 days in custody.

Montgomery said he made arrangements to be treated at the Washoe Tribe Health Center.

"Don't let this chance go away," Gamble said.

Montgomery was sentenced for stealing a dirt bike.
