58-year old gets 3-8 years in prison for subsequent felony DUI

A man, who was found passed out in his vehicle with the key in the ignition and a .3 blood alcohol content, was sent to prison for 3-8 years.

Kevin Patrick Fanning, 58, faced a mandatory prison term for a subsequent instance of felony driving under the influence.

In Nevada, once someone is convicted of a felony DUI, even if they undergo diversion, any additional DUI is considered a felony punishable by up to 15 years in prison.

Fanning was arrested Sept. 1, 2023, after deputies spotted his vehicle stopped but in gear.

“I was lucky I haven’t hurt anyone but myself,” he said at his April 16 sentencing hearing.

During a mental health evaluation, Fanning was determined to be bi-polar, which District Judge Tod Young said didn’t have to define him.

In addition to the sentence, Fanning must pay a $2,000 fine, which he did before he was booked for transfer to the Nevada Department of Corrections.

• A man who admitted busting into a motorhome and hitting the occupant on the head was high as a kite on March 28, 2023, his attorney said.

Daniel Angel De Jesus, 28, received a suspended five-year prison sentence after he entered a no contest plea to residential burglary.

drove to a location off Pinenut Road. The women went into the motorhome. After a time, attorney Martin Hart said DeJesus thought he heard a commotion and broke in with a ball bat and hit the victim demanding money. The resident came up with a machete and cut DeJesus’ hand, according to court documents.

Under an agreement both sides recommended probation.

De Jesus’ probation will last three years. He was given credit for 204 days time served.

• A woman admitted to low level possession of a controlled substance for sale, which is a felony carrying up to five years in prison, and possession of methamphetamine.

Kaela Mae Horse Berreman, 34, admitted to having 14-28 grams of methamphetamine when she was arrested Sept. 30, 2023.

She’s seeking diversion to veterans court. That issue will be decided on May 7.

• A man who admitted selling methamphetamine received a suspended 1-3 year prison sentence on Tuesday.

Andrew Peter Pascual sold the drugs last summer.

His probation will last two years and he was given credit for 16 days time served.

• Three men arrested Jan. 18 after they were pulled over for speeding through town with concentrated marijuana admitted to possession of a controlled substance for sale.

Jahir Asante Castellanos, 20, Erick Thomas Barrios, 18, and Leequann Latee Parker, 20, entered guilty pleas on April 16 in connection with the stop.

Under a plea agreement, prosecutors will recommend probation on the charge which can carry up to four years in prison. Both sides are free to argue for any lawful underlying sentence.
