The Nevada Supreme Court says it’s not double jeopardy for two Hells Angels to stand trial next week on charges stemming from a brawl with rival Mongols motorcycle gang members that injured six at a downtown Las Vegas wedding chapel.
The state high court ruling reported Tuesday by the Las Vegas Sun clears the way for trial to begin Aug. 5 for James Sexey and John Merchant.
Their trial last August with six other accused Hells Angels ended in a mistrial after a judge ruled that prosecutors failed to turn over evidence to defense attorneys.
Five defendants have since pleaded guilty to lesser charges. A sixth is scheduled to take a plea deal Friday.
Sexey and Merchant claim self-defense in the stabbing of two Mongols during the 2008 brawl.
