Man accused of sex with 13-year-old girl

A 21-year-old Gardnerville man is being held on $202,500 bail accused of having sex with a 13-year-old girl.

Juan Daniel Martir was arrested Wednesday and accused of exposing himself to the girl at her Ruhenstroth home.

The incident was discovered by an adult caretaker with whom the girl lives. The caretaker found Martir, identified as a family friend, exposing himself to the girl in the residence.

Sgt. Jim Halsey said further investigation turned up evidence that Martir had engaged in sexual activity with the girl. Martir reportedly admitted to investigators that he had sex with her.

The 13-year-old victim said Martir forced himself on her.

Martir appeared Friday in East Fork Justice Court and asked to be released on his own recognizance.

"I'd like to spend a couple of days with my son," he told Judge Pro Tem Paul Gilbert.

"That's not possible," Gilbert said. "The charges are very serious."

Prosecutor Tyler Altom said the district attorney's office expected to charge Martir with sexual assault, lewdness with a minor under age 14 and indecent exposure.

Gilbert continued the arraignment to Monday when Martir will hear the charges against him and likely be appointed an attorney.
