Six months in jail on drug charge

A 24-year-old Carson City man was sentenced Monday to six months in Douglas County Jail as part of a suspended sentence for possession of a controlled substance for sale.

District Judge Michael Gibbons suspended a three-year sentence in Nevada State Prison and placed Brett Davenport on four years probation after he was terminated from Western Regional Drug Court for getting kicked out of an in-patient treatment program.

Davenport admitted walking away from the treatment program after an argument with his roommate. He reportedly went to a convenience store and bought a candy bar before returning to the Vitality Center at Lake Tahoe.

His lawyer, Kris Brown, said Davenport wanted to go to the Salvation Army six-month treatment program in Reno at his own expense.

He was arrested in July 2008 for selling methamphetamine to a confidential informant.

Gibbons said Davenport could be released to the Salvation Army program from jail.

"This is essentially your last chance," GIbbons said. "If you walk away, you are going to prison."
