Court date set on felony drunk driving charge

A hearing is set before District Judge Dave Gamble on Jan. 12 for a 51-year-old Indian Hills man charged with felony drunk driving.

Dan Beliveau waived his right to a preliminary hearing Wednesday and will proceed to district court.

East Fork Justice Jim EnEarl refused to lower his $10,000 bail.

Beliveau was arrested Dec. 17 at the Chevron station on Mica Drive and Highway 395. According to court documents, his blood-alcohol content was .222, nearly three times the legal limit of .08 for driving in Nevada.

Beliveau has prior convictions in East Fork Justice Court on Sept. 30, 2004, and Aug. 13, 2008.

A third conviction in less than seven years results in a mandatory prison sentence unless the defendant is accepted for a 3-5-year diversion program for felony drunk drivers.

Beliveau indicated he will request the diversion. The district attorney's office is recommending a 12-48-month prison sentence.
