Hearing set in break-ins

District Judge David Gamble set a Nov. 18 hearing for a 20-year-old Indian Hills man accused of breaking into residences in Dayton while eluding Lyon County deputies.

Gamble ordered Casey Smith to remain in Douglas County Jail until officials in Lyon County decide whether to charge him.

"I want Casey to have some in-custody time while we find out what's happening in Lyon County," Gamble said.

Smith's lawyer, Tod Young, said his client had been in Lyon County Jail since he was arrested in July.

According to reports, he fled from deputies who were trying to locate him for failing to appear for drug court. He and his girlfriend reportedly were apprehended in an unlocked Dayton home where they hid in the kitchen in an effort to elude officers.

Smith said Lyon County hasn't filed any charges against him, but Gamble said he wanted more assurance.

"If I do not do this, I would revoke," Gamble said. "I don't know of a kid who's had more chances than Casey. This running around in Dayton is so drug culture."

Young said Smith would be readmitted to Western Regional Drug Court if he remains on probation.

Smith pleaded guilty to trafficking in a controlled substance stemming from a Feb. 28, 2007, drug sale to an undercover officer.

He completed a six-month Department of Corrections discipline program in April.

Gamble sentenced him to 10 years in Nevada State Prison, suspended, and placed him on five years probation after he completed the boot camp. He is subject to random search and seizure for alcohol, controlled substances, contraband and any indicators of drug sales or trafficking.

Prior to the April sentencing, Smith had 315 days in custody.
