Bail reduced for man accused of using 17-year-old in explicit videos

Bail was reduced Wednesday to $10,000 cash for a 42-year-old Johnson Lane helicopter mechanic accused of making nude videos of a 17-year-old girl in exchange for the use of a car.

Troy Marvin Creeks is charged with use of a minor as a subject of sexual portrayal in a performance, a felony that carries a penalty of up to life in prison.

He was arrested two weeks ago after the girl's mother found a handwritten contract that required the 17-year-old to perform nude in videos in exchange for use of a car.

His lawyer, Tod Young, pointed out that if Creeks had sex with the girl, there be no crime.

"This is quite a unique circumstance," Young said. "This gentleman is accused of a category A felony. The allegations have to do with the ambiguous phrase 'a minor.' There is nothing in the probable cause report to indicate this woman was coerced or forced to do anything she wasn't willing to do. She has a 3-year-old child. If he'd actually had sex with her there would have been no crime whatsoever."

Justice of the Peace Jim EnEarl told Creeks if he bails out, he would be on house arrest and could have no contact with the victim.

"I don't know that you did this," EnEarl said. "But something is wrong if Placer County is investigating you. Something is not right. Regardless if it happened, it's the dumbest damn thing I've ever read in my life."

According to reports, Placer County officials are investigating a report that Creeks paid a minor to perform oral sex.

"I met your folks," EnEarl said. "They seem like fine, concerned people. You need to take a look at what you're doing with your life."

Court documents indicated that Creeks admitted making the video of the 17-year-old and told investigators where to find it in his Johnson Lane home.

If he is released from jail, EnEarl said he could have no contact with anyone under 18 except family members and may not possess sexually explicit materials.

He is to return to court Jan. 7.
