Sex offender gets five years in prison

A 26-year-old Indian Hills man with two prior felony convictions for statutory sexual seduction was sentenced Tuesday to five years in Nevada State Prison for a third offense.

David B. Reddington denied he committed the offense, but said he pleaded guilty to avoid prosecution on a more serious charge.

"At various times, a term I use is 'oxygen waster,'" Judge Dave Gamble said. "I don't believe anything you just said to me. I think if I could send you to prison longer, I would."

Reddington was arrested July 26, but denied the 15-year-old victim's account of what happened.

According to defense lawyer Derrick Lopez, the victim had been drinking and passed out, and may have believed it was Reddington who sexually assaulted her, but there were other men present at the residence.

Lopez said the girl's younger sister walked in on the girl and another man and the 15-year-old knew nothing of what happened until her sister told her.

Reddington was convicted in California twice of having sex with a 17-year-old he said was his girlfriend. He told Gamble he would have admitted having sex with the Indian Hills girl if it were true.

Prosecutor Tom Gregory said he was concerned about a psychosexual evaluation of Reddington which said he was at low risk to reoffend unless he was around children.

"This is the third sex offense for somebody who is 26 years of age," Gregory said.

Gregory said the report indicated that Reddington would not benefit from sex offender treatment programs, and might use the information to his advantage as an offender.

"He sounds like someone who can't be rehabilitated," Gregory said.

Gamble told the lawyers to determine whether Reddington must register as a sex offender.

"If I could impose lifetime supervision, I would," Gamble said.
