Man arrested for photos
A South Lake Tahoe man faces up to three years in Douglas County Jail after he pleaded guilty Monday to possessing photographs which showed him in various sexual poses with five girls under the age of 16.
David Cullen Hudacek, 52, pleaded guilty to three counts of possession of visual presentation depicting sexual conduct of a person under the age of 16. The photographs allegedly were taken in 1984-85, according to chief criminal deputy district attorney Kristine Brown.
At the time the pictures were taken, the girls were between the ages of 9 and 12.
Brown said one victim was located by investigators and did not want to be interviewed or involved in Hudacek’s prosecution.
“The victims never came forward,” she said. “If the case came to trial, the girls would be forced into the public arena. I’m guessing at their feelings, but I would be heartsick if I knew these photos existed and would be shown to a jury.”
Brown said the photos were found in a crawl space of Hudacek’s former residence after he moved out. The new tenants found the pictures and turned them over to the sheriff’s department. Hudacek was arrested in June.
The girls were traced through school yearbooks after their ages were estimated by a pediatrician, Brown said.
Hudacek originally was charged with 15 felony counts, but agreed to plead guilty to three gross misdemeanors in a plea bargain with the district attorney’s office. Although Hudacek is pictured in the photographs, he is not charged with committing any crimes against the girls because the statute of limitations has expired, Brown said.
“I can look at the facts that you are in some of the photographs that allege you are engaging in some of these acts,” said District Judge Michael Gibbons.
Hudacek will have to register as a sex offender after his sentencing Sept. 15. He remains in Douglas County Jail on $5,000 bail. Originally, his bail was set at $100,000.
