A Ruhenstroth man waived his preliminary hearing on charges stemming from a May 24, 2024, shooting incident at his home.

David Clayton Fagan, 37, appeared in East Fork Justice Court with his attorney Maria Pence.

He was ordered to appear in Douglas County District Court on March 11 in connection with a felony involving the incident in a Colt Lane home where he and his father struggled over a firearm. Fagan shot up the house.

Fagan admitted to three misdemeanor counts in justice court related to a Nov. 14, 2023, driving under the influence, where he’d struck the community’s cluster mailbox. Those charges included the DUI, failure to report a collision and possession of a firearm while intoxicated.

Fagan’s firearms were confiscated. He was a high school teacher and football coach before the incident last year.

Gonzales said he was fleeing threats and absconded from supervision. He was arrested in Las Vegas after parole officers issued a report on Oct. 30, 2024. He returned to Douglas custody on Jan. 18.
