Robbery with a deadly weapon and burglary of a business charges were dismissed by prosecutors against a Reno man.
Curtis James Brahic has denied the charges all along.
According to court documents, Brahic was scheduled to go to trial in May and during an April 23 pretrial hearing, a motion was granted to suppress body camera recordings from deputies who took him into custody.
According to the motions filed by attorney Matthew Ence, Brahic asked for an attorney. Prosecutor Jim Sibley sought to use the material, but dismissed the charge after the motion was granted.
In the court transcript, Sibley didn’t oppose the motion, acknowledging the material couldn’t be introduced.
Brahic was accused of displaying a firearm during an encounter with Walmart security on Dec. 30, 2022. The case hinged on video and testimony about the encounter in which a security officer asked Brahic, who’d been walking through the store picking up items, if he’d taken something.
Brahic opened his jacket to reveal a firearm in a holster.
In November, an error in a charging document resulted in a mistrial.
However that error, was ruled unintentional and a new trial date was set.
It was during a pretrial motions hearing before that May trial that it was determined the body camera footage was inadmissible.
