Teen plans to admit cocaine charge

A 19-year-old Carson City woman accused of selling cocaine to an undercover informant plans to plead guilty in District Court on Monday and request admission to drug court.

East Fork Justice Jim EnEarl was ready to send Tifany Fraker back to jail Wednesday after she tested positive twice for marijuana since the beginning of the month.

"You lied to me and you smoked dope," he said. "You can't even stay out of trouble when you know you might go to prison."

Fraker asked to stay out of jail because she had a second job interview and is the sole support of her 18-month-old daughter.

"This is the dumbest move I have made in some time," EnEarl said as he allowed her to remain out of custody. "You're lucky they're not charging you with internal possession of marijuana and tacking on two felonies."

He ordered her to appear before District Judge Michael Gibbons on Monday to request drug court, and to be tested at 8 a.m. each weekday before court.

"If you test positive on any day, you'll go to District Court wearing someone else's clothes," he said.

She waived her right to a preliminary hearing on Wednesday.

Her attorney, Derrick Lopez, said Fraker planned to plead guilty to conspiracy to violate the Uniform Controlled Substances Act. A co-defendant, Bailey Jo Garcia, admitted the charge last week and was accepted for Western Regional Drug Court.

If they successfully complete the program, their charges may be dropped.

The two 19-year-olds and a 17-year-old girl were arrested Aug. 7 by Douglas County Street Enforcement Team and Tri-Net narcotics officers after reportedly selling 7 grams of cocaine.

The 17-year-old is to appear in juvenile court on Oct. 29.

-- A preliminary hearing is set Oct. 25 for a South Lake Tahoe man accused of breaking into a real estate agency van.

John Taylor was arrested Oct. 12 after deputies were called to McDonald's about a man who was harassing customers for a cigarette. They spotted Taylor, 33, outside the restaurant and learned there were three warrants for his arrest from South Lake Tahoe and Tahoe Township Justice Court.

As deputies prepared to take him to jail, he asked to be taken to a van in a nearby parking lot to retrieve his backpack.

Deputies said the van door was open and they found the backpack under what they believed to be burglary tools with a checkbook belonging to the van owner and a nearly empty 13Ú4 liter bottle of vodka.

Deputies said the ignition system had been pulled out and they found a bloody screwdriver on the floor.

Even though Taylor had a fresh cut on his thumb, he denied responsibility for the break-in.

He was charged with burglary and was in custody in Douglas County Jail on $45,187 bail.

-- The Douglas County Sheriff's Office reported 29 contacts for domestic violence Oct. 3-16.

There were 20 verbal domestics, three adult arrests for domestic battery and one juvenile arrest, three unsubstantiated reports for domestic battery and two referrals to the district attorney for warrants, review or prosecution.

Nine juveniles witnessed domestic violence and two juveniles were suspects.

The Family Support Council submitted three requests to East Fork Justice Court for temporary restraining orders with two approvals and one denial. One request for an anti-stalking and harassment order was approved.

Connie Richardson, sheriff's office domestic violence prevention coordinator, said the average range for contacts is 16-22 per week for the time frame, The average number of children witnessing domestic violence is 9-1 per week with juvenile suspects at 0-2 per week.
