A judge on Monday denied a request to move a Carson City teenager to a juvenile facility while he awaits trial as an adult on sex-assault charges.
Brandon Leigh Hubbard, 17, was certified as an adult in October 2002 by a juvenile court master. He is charged with four counts of sexual assault, two counts of battery with intent to commit sexual assault and kidnapping in an August 2002 rape.
District Judge Michael Griffin denied the defense's motion, saying if he did grant the request, he'd be ruling on the original move to have Hubbard tried as an adult.
Hubbard, is 6 feet 1 inch tall, allegedly met the victim at a Carson City bar on Telegraph Street on the evening of Aug. 2, 2002. They met again that evening at a bar on Winnie Lane, where they talked for a while outside then walked across the street to an empty parking lot.
The victim said it was there that Hubbard raped her first. For the next three hours, she said during a preliminary hearing, he kept her under his control through force and death threats, walking her around the west-side neighborhood.
From the backyard of a home on Michael Drive, the woman was able to escape and flag down a passing car. She and the motorist found a sheriff's deputy at 6:30 a.m.
A trial is set for May. Hubbard remains in jail on $500,000 bail.
