Teen accuses man in kidnapping
September 30, 2004
A Gardnerville Ranchos man arrested Wednesday and charged with five felony counts for kidnapping and sexually assaulting a 19-year-old girl over a five-day period is scheduled to appear in East Fork Justice Court 8:30 a.m. today.
Kenneth Pestana, remained in Douglas County jail on $500,000 bail Thursday morning. The Douglas County Sheriff’s Special Weapons and Tactics team arrested him 5 a.m. Wednesday at his Centerville Lane home.
The warrant was served and Pestana was taken into custody without incident. The warrant has been sealed by East Fork Justice Court.
Pestana is charged with felony kidnapping with the use of a deadly weapon, sexual assault with the use of a deadly weapon, two counts of sexual assault and supplying a controlled substance.
The 19-year-old female victim told investigators that sometime during the first week of September she was willingly at Pestana’s home, where he allegedly gave her methamphetamine, according to sheriff’s office spokesman Sgt. Tom Mezzetta.
The criminal complaint in the justice court file charges Pestana with using a knife to keep her from leaving.
Mezzetta said when the victim attempted to leave Pestana stopped her.
“The victim was allegedly held against her will – at times bound at the wrists and ankles – for nearly a week,” he said. “The 19-year-old woman reported to have been sexually assaulted repeatedly during this time.”
Mezzetta said he wasn’t sure whether the victim escaped or was let go.
The delay from the date of the allegations to the arrest was on the part of the victim, who reported the allegations Tuesday, he said.
“It didn’t take us long. We received the information (Tuesday), and our investigators, the district attorney and the judge worked through the night drafting up a complaint, arrest warrant and search warrants,” Mezzetta explained. “The delay certainly was not on our part.”
Police recovered “items of restraint,” described by the victim from Pestana’s home.
He said no other arrests are anticipated.
Mezzetta said police had been to the home at 1085 Centerville Lane at least twice, once in March 2003 and again in October the same year. Both calls were domestic violence calls. No one was arrested in either case.
Pestana faces could be sentenced to multiple life sentences if convicted of kidnapping and sexual assault.
