A Gardnerville couple accused of ringing up more than $4,800 in credit card fraud was sentenced Monday to probation and ordered to make full restitution.
District Judge Michael Gibbons sentenced Douglas Goldy, 26, and Melissa Miller, 38, to 32 months in Nevada State Prison, suspended, and placed them on five years probation each.
He said the probation was in consideration for assistance Goldy was providing to law enforcement.
The couple was ordered to perform 50 hours of community service. He stopped short of forbidding them from seeing each other because they have a child.
The defendants denied making cash advances of $1,800, but agreed to pay it back to the cardholder.
How could it have happened all at the same time period if the cardholder didnt have the credit card and the defendants did? Gibbons asked.
Gibbons set a hearing for four weeks to review the suspects claim.
He also sentenced Miller to Western Regional Drug Court at her request.
I have a long history in my life of drug use, she said. After 2004, I maintained my sobriety for a little over three years. I want that back.
Goldy apologized.
Drug use makes us believe its OK to do things that are wrong, he said.
